In an important victory for a statute-abiding Florida insurer, the Third District Court of Appeal affirmed a trial court’s ruling dismissing a claimant’s malicious prosecution suit against the insurer for reporting him for suspected insurance fraud.

Not surprisingly, the National Insurance Crime Bureau recently reported that Florida leads the nation in fraudulent insurance claims; it has done so for years. As if its first-place rank was not enough, according to the recent NICB report Florida has recorded a more than 22 percent rise in questionable insurance claims since 2010. Almost half the questionable claims reported in 2012 came from Miami-Dade, Broward and Palm Beach counties.
