A lawsuit for theft and fraud has been filed against Timothy McCabe, the fugitive Lake Worth real estate attorney whose license was suspended after he disappeared with about $4 million from his law firm’s accounts.

William Scherer of Conrad & Scherer in Fort Lauderdale filed the lawsuit May 14 in Palm Beach Circuit Court on behalf of Timothy Sweetman, an investor who entrusted McCabe with a $50,000 escrow deposit to execute a short sale on a property in foreclosure. The lawsuit names as defendants McCabe, his law firm and former partner Steven Samiljan.
