On Day One of a new state medical malpractice law, five federal and state lawsuits were filed challenging a change allowing defense attorneys to talk to an injured party’s doctors as a prerequisite for legal action.

Signed into law June 5 by Governor Rick Scott, the ex parte bill requires a plaintiff to give a defendant’s doctor 90 days pre-suit notice that a medical malpractice lawsuit will be filed.
