A Palm Beach County man struck out in federal court when he tried to fight back against unsolicited text messages from Pizza Hut.
U.S. District Judge Kenneth Marra in West Palm Beach decided Monday that the lawsuit was moot because the plaintiff had been offered a legitimate settlement of “full relief” under the Telephone Consumer Protection Act before seeking class certification.
