China is the world’s leader in the number of registered trademarks, but it lags way behind the rest of the world in protections for brand owners. The new revisions to China’s trademark laws enacted Aug. 30, 2013, and set to go into effect on May 1, 2014, aim to bridge this gap. Among other changes, the revamped law is designed to shorten and streamline the trademark application process, prevent bad faith registrations and trademark hijacking, and increase penalties for trademark infringement.

Brand owners are well advised to learn about the new legislation and its potential effects on their trademark registration and enforcement efforts in China.
