Many Florida businesses have been the subject of lawsuits filed by “testers” under Title III of the Americans with Disabilities Act.

Testers are people with disabilities who visit places of public accommodation, such as grocery stores, specifically to determine whether they comply with the accessibility requirements of Title III of the ADA. When the tester finds a noncompliant business, the tester files a lawsuit alleging violations of the ADA.
