Trial courts can’t consider the legality of a contract when deciding whether to enforce arbitration awards, the Florida Supreme Court ruled.
The unanimous opinion written by Chief Justice Jorge Labarga upheld an arbitration award to Visiting Nurse Association of Florida Inc., a home health-care agency, under a contract with Jupiter Medical Center Inc. The high court quashed a Fourth District Court of Appeal decided and sided with Palm Beach Circuit Judge David E. French.
