Everyone agrees the juvenile threatened and then pushed the officer in the chest, but the state was wrong to charge the boy with assault on a police officer, an appeals court has ruled.
A reversal of that conviction by the Fourth District Court of Appeal was the lesson this week on when an officer is no longer acting like an officer.
