A divided appeals court Friday tossed out a $2.4 million verdict in the death of a construction worker who was struck by a 2,000-pound steel column, ruling that the case should have been handled in the workers’ compensation insurance system.

The Marion Circuit Court case stemmed from the 2010 death of Victor Lizarraga, a foreman for a subcontractor erecting steel columns on a warehouse-expansion project.
