A cruise line that mistakenly sold a 20-carat, $5 million diamond to a passenger for pennies on the dollar may have to stand by its agreement after an appeals court on Wednesday ordered a trial in the case.

Thomas DePrince was a passenger on a Starboard Cruise Services Inc. ship when he wandered into the onboard jewelry store and asked for a price on a large loose diamond.
