The U.S. Supreme Court selected for review during the current term several class action cases. Given the resistance to class actions exhibited by a majority of the current court, class action lawyers predicted the court would further impede plaintiffs’ ability to maintain large class action actions.
As the smoke clears, it appears this term may not live up to the hopes of the class action defense bar.
