A jury found a tobacco company primarily responsible for a smoker’s chronic obstructive pulmonary disease but determined the disease did not cause his death.
James Ewing, who died in 2009 at 67, was a heavy smoker for decades, smoking up to two packs per day. His attorneys claimed his addiction to R.J. Reynolds Tobacco Co.’s cigarettes led to his COPD.
