In the third case of its kind filed last week in the Florida Supreme Court, a Lakeland attorney is challenging whether Gov. Rick Scott should be able to appoint a replacement for a circuit judge who plans to retire in December.

A petition filed Thursday on behalf of attorney Steve Pincket contends that the seat held by Judge Olin Shinholser of the 10th Judicial Circuit should be filled through an election this fall, instead of by gubernatorial appointment.
