A Brazilian tourist seemed to be doubly unlucky: First he claimed he was beaten up by Miami Beach hotel security guards when trying to sell his tickets to the Ultra Music Festival, and then his lawsuit against them was thrown out because he didn’t make it back to the U.S. in time for trial.

But things are looking up for Rodrigo Daher after an appellate court ruled Wednesday that his trial should be rescheduled to account for visa difficulties.
