An amusement park has been mostly cleared in a premises liability case. Antonio Martins sued Festival Fun Parks LLC, operator of Boomers! amusement park in Boca Raton after his 10-year-old daughter crashed a go-kart into a concrete nose, near the ride’s pit area, fracturing her ankle in 2012. Martins’ counsel claimed the area around the ride was not reasonably safe. The defense denied negligence, arguing the father was at fault for allowing his daughter to operate a kart despite the fact she had limited kart experience. And the jury agreed for the most part, finding Martins 80 percent liable, the daughter 5 percent, and Festival Fun 15 percent, for only a net $790 award, after a reduction for comparative negligence.
