A proposal for settlement is an essential tool that is likely built into all litigators’ legal strategy as a way to encourage settlement or obtain a judgment of attorney fees if no settlement is reached.

In either case, the proposal for settlement benefits both the attorney and the client and is widely used as a result. This tool has become so routine in Florida litigation that many attorneys may, and often do, serve proposals for settlement that do not hold up to scrutiny.
