The Fourth District Court of Appeal abruptly switched gears by issuing a one-paragraph decision to end a case the court had agreed to reconsider.

The case of ERP v. Sanders is likely headed for the payment of a $1.8 million jury award after Wednesday’s decision issued without an opinion. With costs and post-judgment interest the award has grown to about $2.8 million, according to the winning appellate lawyer, Philip Burlington of Burlington & Rockenbach in West Palm Beach.
