The Rules of Judicial Administration and those of civil procedure appeared to collide in a Palm Beach County courtroom when a circuit judge spontaneously threw out a case that had languished for about 18 months.

On one hand, Florida’s Rule of Judicial Administration allow 12 months from filing to final disposition for nonjury cases. On the other, procedural due process requires judges to give fair notice and a reasonable opportunity to be heard before ruling.
