A verdict for a restaurant in a labor and employment case in Miami federal court is being hailed among litigators as a victory for thousands of U.S. businesses opposed to an Obama administration proposal to increase the number of employees eligible for overtime pay.
Jurors found for BurgerFi in a decision that offered some clarity for retailers and other businesses whose managers often perform both administrative tasks and manual labor, blurring the line between those who qualify as exempt professionals under federal law and those who don’t. They sided with the restaurant, returning a defense verdict Dec. 19 that found a middle manager exempt from overtime pay, despite her responsibilities in the kitchen.
