A woman severely burned by an explosion from a police flashbang grenade thrown while she was sleeping cannot sue because the officers are protected by immunity from litigation, the U.S. Court of Appeals for the Eleventh Circuit has decided.
Judge William Pryor Jr. wrote the opinion, ruling that, even though the officer used excessive force, he is entitled to qualified immunity. Pryor also wrote that the officer’s supervisor enjoys qualified immunity.
