Florida’s process of selection and oversight of trial judges makes our judiciary a model for the nation. Even so, hard-working civil trial judges can sometimes feel overburdened with heavy caseloads, and the resulting pretrial motion practice.

Litigants can also feel frustrated. It can be difficult to obtain hearing dates on short notice or to set aside enough court time to resolve all pending issues, big and small. Parties can find themselves unable to nip troublesome issues in the bud. The lack of quick access to the court can tempt some lawyers to abuse the system and drive up costs with needlessly contested depositions and unnecessary motion practice.
