A Miami judge declared a mistrial Monday in Espirito Santo Bank’s $170 million negligence suit against Chicago-based auditing giant BDO Seidman.

Miami-Dade Circuit Judge Jose Rodriguez ended the trial after attorney Gonzalo Dorta, a solo practitioner for Espirito Santo, referred to the 2003 suicide of a former BDO executive while questioning a witness Feb. 27.
