A federal judge in Los Angeles has tossed a suit related to a fatal accident on a South Georgia train trestle that derailed a biopic of blues rocker Gregg Allman

The ruling came just four days before Allman himself passed away at his home in Savannah after years of struggling with complications from liver disease. Allman, 69, was not a party to the just-dismissed litigation.  

The lawsuit sought to have an insurer pay more than the $5 million it has already spent settling litigation stemming from the 2014 accident.
