One of Greenberg Traurig's big wins for its labor practice group was its representation of Zaxby's in a putative collective action brought by Ayotunda Lovett on behalf of herself and others claiming Zaxby's didn't pay proper overtime compensation.

Specifically, the plaintiffs alleged they were entitled to unpaid overtime wages and liquidated damages under the Fair Labor Standards Act (FLSA) because although their titles were manager or assistant manager, they actually were misclassified and should have been paid hourly. 

According to the firm, after discovery commenced, one of the plaintiffs admitted she was an hourly employee and was paid hourly for all wages earned.
