A client lawsuit accusing Alston & Bird of fraud, unjust enrichment, legal malpractice and other claims will go forward after a Fulton County judge rejected arguments by Alston's counsel to throw out the bulk of the claims.

Fulton County Superior Court Senior Judge Elizabeth Long signed the order July 5 denying a motion by Alston's King & Spalding counsel to dismiss multiple claims outlined in a suit against the law firm brought by the Atlanta-based investment firm MSouth Equity Partners last March.

MSouth is seeking to recover more than $7.6 million in taxes and interest it claims it was forced to pay in the wake of an investment deal involving another Alston client, a firm in which MSouth held a majority interest. MSouth's suit claims its partners relied on legal advice by Alston attorneys—advice that was allegedly based on a multimillion-dollar math error, according to the complaint filed by MSouth's Atlanta attorney Joseph Wargo. Alston lawyers then allegedly tried to cover up to shield the law firm from liability.
