The U.S. Court of Appeals for the Eleventh Circuit has denied a Florida couple’s request to rehear a case that deeply divided the judges over what constitutes a legal police search.

The 12 members on the court—including the newest, Judge Kevin Newsom, President Donald Trump’s appointee—issued an order Wednesday denying the request to rehear en banc a case involving a home search carried out under false pretenses.
