We're at the end of the second week of testimony in the trial of former Fisher & Phillips partner Claud "Tex" McIver in Fulton County Superior Court. Prosecutors say McIver intentionally shot his wife to death in 2016 to gain access to her money. McIver and his lawyers say Diane McIver died in a tragic accident caused in part by Tex McIver's sleep disorder that causes his body to act out during dreams. Dani Jo Carter, a close friend of the McIvers who was driving their SUV when the shooting occurred inside, testified for 2½ days, addressing when Tex McIver slept in the vehicle and asked for his gun. She also testified about comments he made to Carter at the hospital and after Diane McIver died. Carter's husband, Tom, took the stand and answered questions about telephone calls he received from Tex McIver after the shooting. Later in the week, a police officer told the jury what he overheard McIver and his lawyer discussing at the hospital, and prosecutors showed a video of officers' interview with McIver and his counsel two days after the shooting. These photos were taken and cutline information was provided by photographers from The Atlanta Journal-Constitution, which has been designated to provide pool photography for news media covering the trial.
