There's still time to comment on proposed changes to the Eleventh Circuit Court of Appeals, but those wishing to weigh in must do so soon with the May 4 deadline approaching.
There are 15 rule changes under consideration by the court, including some that are essentially housekeeping measures, such as a requirement that attorneys and pro se litigants notify the court of address changes.
Others will impact filing deadlines for cases where other motions are pending or when a court order setting aside a dismissal is docketed.
Among other proposed revisions:
- Exhibits containing child pornography may not be transmitted to the court unless the clerk of the court has requested that they do so.
- Parties wishing to file emergency motions must contact the clerk's office by telephone or risk the motion being delayed.
- The clerk's office will be authorized to consolidate appeals even when no such consolidation was requested in the interests of judicial economy or where required by statute.
- Amend the court's operating procedures to reflect that those registered to use the court's electronic filing system may file original pleadings and pay the docketing fees electronically.
The proposed amendments are on the court's website at http://www.ca11.uscourts.gov/rules/proposed-revisions or at the Eleventh Circuit Court.
Comments can be submitting at that address or in writing to: Office of the Clerk, U.S. Court of Appeals for the Eleventh Circuit, 56 Forsyth St., N.W., Atlanta, GA 30303.
