A federal appeals court revived malicious prosecution claims against an Albany police officer who arrested and jailed a man on a felony murder charge that was later dropped when he agreed to testify against other defendants. 

The opinion from the U.S. Court of Appeals for the Eleventh Circuit, published Tuesday and authored by Chief Judge William Pryor, said the dismissal of the murder charge constituted a “favorable termination” for the purposes of sustaining his claim that his Fourth Amendment right to be free from unreasonable seizure was violated.
