Six months into the COVID-19 emergency shutdown of courts in Georgia, ADR has undergone forced changes that have been imposed on most professions and businesses. “Virtual” is now, and will be for the foreseeable future, the standard for interactions among litigants and their advocates. Civil jury trials could easily face two years of delay as criminal dockets will demand the attention of courts if and when either a COVID-19 vaccine or a cure permit face-to-face courtroom engagement.

The news from the ADR front is mostly positive, however. After having conducted many mediations and a couple of arbitrations utilizing the Zoom platform, pros, cons and best practices can be identified.
