A federal appeals panel has sent a trademark suit brought by a Georgia college back to the district judge with an unusual question: Who won the case we are supposed to be reviewing?

The oddity comes six years into a battle between the expansive Savannah College of Art and Design and Sportswear Inc., which sold T-shirts and other apparel on a website that allowed customers to add their purchases with a host of logos, including SCAD’s. The college claimed trademark infringement, resulting in two laps through the federal court system.
