A federal appeals court heard oral arguments Tuesday on whether the courts have authority to grant the first media leaker prosecuted by the Trump administration compassionate release from prison after she contracted COVID-19.

Reality Winner’s lawyers on Tuesday sought to convince a panel for the U.S. Court of Appeals for the Eleventh Circuit Court that judges have discretion to grant inmates compassionate release when the U.S. Bureau of Prisons fails to act. Winner wants to serve the remainder of her 63-month sentence at home due to her medical history that puts her at heightened risk, now that she has contracted COVID-19.
