Emory University has won a second chance to get out from under a $12.5 million judgment that was part of a $20 million verdict for the death of a patient in a sleep center.

The U.S. Court of Appeals for the Eleventh Circuit vacated a grant of summary judgment in favor of Neurocare Inc., the Boston-based contractor doing business as the Center for Sleep Diagnostics and providing services to Emory University Hospital. The court remanded the case to District Judge Steve Jones of the U.S. District Court for the Northern District of Georgia. The decision allows Emory—which operates Emory University Hospital, The Emory Clinic and the Sleep Center—to proceed with its 2017 lawsuit against Neurocare to recoup damages and the legal costs Emory incurred while defending the case.
