Heraclitus once said, “[t]he only constant in [eDiscovery] is [new social media platforms and other] change[s].” Accordingly, this article highlights three issues you may encounter for the first time on your next case and how to get started with them: new social media platforms, ephemeral messaging and links to documents (instead of attachments).

Clubhouse is the newest social media craze that has the potential to be the next Silicon Valley unicorn. Clubhouse is an “invitation-only audio-chat social networking app.” If that is gibberish, try: “a live podcast.” And if that is gibberish, you have a lot more work to do than simply reading this article. Clubhouse comes on the heels of TikTok, which was undoubtedly the latest social media app to take the world by storm (reported to have 100 million users in the U.S. alone per month, and over 2 billion downloads globally).
