A woman whose SUV was rear-ended by a Ford Focus in a collision she later drove away from netted a $400,000 jury award in Fulton County after her lawyers were able to overcome evidence that she’d been previously treated for back and neck pain. 

Because she had previously offered to settle the case for $200,000, lead plaintiffs attorney Tyler Schermerhorn said they may be filing to recover attorney fees under Georgia’s Offer of Settlement statute, which allows a party to seek such fees from the time an offer is made if the opposition party rejects it and the final judgment is 25% or greater of the spurned offer.
