With an unsigned “shadow docket” procedural ruling from the conservative majority of the U.S. Supreme Court, Texas managed to pull off what Georgia and a dozen other states have been trying to do for years: End legal abortion.

“They’ve created a hole through which a state can drive a truck,” David Walbert of Parks Chesin Walbert told Law.com, an ALM affiliate of the Daily Report, on Friday after reviewing the high court’s 5-4 ruling issued just before midnight Sept. 1. “It’s an unholy alliance between cynical politicians in Texas and a majority of Supreme Court justices who were hand-picked to do what they just did.”
