Shortly after being acquitted of stalking and other charges in Oconee County the plaintiff was tried and convicted on a related aggravated stalking charge, serving his entire 10-year sentence before the Georgia Court of Appeals said his constitutional double jeopardy rights were violated.

A man who spent 10 years in jail after being convicted of aggravated stalking has sued three former Western Judicial Circuit prosecutors in Georgia, saying they violated his constitutional protections against double jeopardy.
