Two of the most important things for a successful mediation are making sure the lawyer is prepared and has all of the information needed for a meaningful mediation and preparing the client for mediation and setting realistic expectations.

Attorney preparation is a critical component to having a meaningful discussion regarding resolution. Many times, lawyers come to mediation in a personal injury case without knowing the amount of their clients’ medical bills, liens, Medicare interests, etc. which serves as a significant impediment to reaching a resolution. A lawyer who is prepared and has all of the facts, figures and details pinned down can talk logically and make educated recommendations to his or her client in order to reach a fair resolution.
