R. David Ware, Phillip E. Friduss and Nicholas Kinsley of Hall Booth Smith have stepped in to represent the City of Atlanta in a wrongful death lawsuit arising from a 2020 police shooting. The suit, filed Sept. 9 in Georgia Northern District Court, alleges that the lack of proper de-escalation training, use of excessive force and denial of medical care resulted in the death of 27-year-old Rayshard Brooks during a confrontation in a Wendy’s parking lot. The suit was filed by Spears & Filipovits and Stewart Miller Simmons Trial Attorneys on behalf of Brooks’ estate and his widow Tomika Miller. The case, assigned to U.S. District Judge Steven D. Grimberg, is 1:21-cv-03752, Miller et al v. The City of Atlanta, Georgia et al.
