Defective deed? Get an affidavit from a subscribing witness, a person who sees the deed get signed by other parties and then signs afterward indicating this.

That’s been the go-to remedy for many property lawyers, but a ruling handed down by the U.S. Court of Appeals for the Eleventh Circuit has limited the quick fix to fewer deeds, following a statutory amendment.
