Counsel at Swift, Currie, McGhee & Hiers and Pietragallo Gordon Alfano Bosick & Raspanti on Friday removed a wrongful death lawsuit against Viatris, a drug company formed through the merger of Mylan and Pfizer’s Upjohn business, to Georgia Northern District Court. The complaint, filed by McCamy Phillips Tuggle & Fordham on behalf of Stephen Swinney, contends that the packaging of Viatris’ birth control patch Xulane was defective for failing to warn consumers that the patch posed a serious risk of deep vein thrombosis and death to women whose body mass index is above 30 kg/m2. The case is 4:22-cv-00090, Swinney v. Mylan Pharmaceuticals, Inc. et al.
