Acuity, a mutual insurance company, sued Lane's Equipment Rental and other defendants Friday in Georgia Northern District Court in connection with apportionment of a $21.6 million judgment. Acuity, which had offered to settle the motor vehicle tort claim for $130,000, seeks declaratory judgment that its obligation under auto liability and excess liability policy sections is capped at $2 million. The suit also seeks a ruling that any disputes should be adjudicated under Tennessee law. Counsel have not yet appeared for the defendants. The case is 4:22-cv-00101, Acuity v. Lane's Equipment Rental, Inc. et al.
