It’s been more than four years since an Atlanta photographer assigned to take real estate listing photos got shot by a homeowner who mistook him for an intruder. Now Whitney Morris’ legal fight to hold Real Estate Expert Advisors of Buford and its owner, Tracy Cousineau, accountable for negligence has landed before the Georgia Court of Appeals.

After a trial court granted summary judgment to the real estate defendants, nixing liability, appellate attorneys are arguing over whether the real estate company’s failure to notify its listing client, Belinda Brooks, of a rescheduled photography appointment amounted to negligence, and potential culpability for the photographer’s injuries.
