In a recent Gallup poll, the U.S. Supreme Court’s approval rating hit a historic low—a disturbing 25%. In a recent CNN poll, Americans by a decisive margin – 66% to 34%—said that they did not want to see Roe v. Wade, 410 U.S. 113 (1973), completely overturned.

Last Friday, five justices, including former President Trump’s trio of nominees (Neil Gorsuch, Brett Kavanaugh and Amy Coney Bennett), voted to completely overturn Roe and Planned Parenthood of Southeastern Pa. v. Casey, 505 U.S. 833 (1992). See Dobbs v. Jackson Women’s Health Org., 597 U.S. __ (2022). They did so in strident and imperious language characterized by Chief Justice John Roberts as “a relentless freedom from doubt” and by the dissenters as “doctrinal” and institutionally unwise.
