The Georgia Supreme Court has reversed Claud Lee “Tex” McIver III’s murder conviction for the 2016 shooting death of his wife, Diane, ruling the trial court was mistaken in denying his request to charge the jury on a lesser involuntary manslaughter offense.

In its opinion released Thursday, the court reversed a Fulton County Superior Court jury’s convictions for felony murder and possession of a firearm during the commission of a felony but upheld its conviction for influencing a witness. During his 2018 murder trial, McIver’s lawyers argued that he accidentally shot his wife while riding in the car with her.
