The Supreme Court of Georgia will clarify whether equitable exceptions clear the way for adult children to bring wrongful-death actions when their dead parent’s surviving spouses opt not to file suit.

During oral arguments Tuesday, appellant counsel challenged a Georgia Court of Appeals ruling that stripped a woman of her ability to sue medical providers on behalf of her dead father after the man’s wife refused to sue.
