The Georgia Court of Appeals has upheld the dismissal of a lawsuit filed by a conservative organization regarding the removal of Confederate monuments in Henry County, but the group has an avenue to refile the suit.

In an opinion released June 29 and included in an ALM Court Opinions newsletter Wednesday, the court ruled against the Sons of Confederate Veterans, which had sued the Henry County Board of Commissioners over the issue. That suit, along with two others in a nearby county, Sons of Confederate Veterans et al. v. Newton County Board of Commissioners and Humphries v. Newton County Board of Commissioners, were combined when they were appealed to the Court of Appeals. The lower courts dismissed the suits, citing standing and sovereign immunity as the reasons.
