Former longtime Fisher & Phillips lawyer Claud “Tex” McIver will remain in jail in Atlanta after a judge ruled on Thursday that he not be released on bond because of the “temptation” of fleeing before his new trial on murder charges in the 2016 shooting death of his wife.

Fulton County Superior Court Judge Robert McBurney stated in his order he shared concerns about McIver not receiving proper medical care while in custody. But McIver was seeking bond “on the eve of the [December] retrial of his (felony) murder case”  and “the temptation to abandon this replay of the drama of his wife’s shooting death is simply too great,” the judge wrote.
