Hours after conducting an emergency hearing, Atlanta Judicial Circuit Judge Rachel Krause declined to stay certification of prevailing candidate Jeff Davis’ May 21 election to the Georgia Court of Appeals on grounds the request had become moot.

In an order issued just after 5 p.m. Friday, Krause dismissed the pre-election challenge launched against Davis’ candidacy by Augusta attorney Randolph Frails in his capacity as a Georgia voter. According to the order, Frails’s motion had become moot, since Georgia Secretary of State Brad Raffensperger certified the intermediate appellate election results before Krause rendered a decision about the petitioner’s motion to stay certification.
