The Georgia Court of Appeals issued an opinion reversing a trial court’s assessment of costs against a plaintiff despite never empaneling a jury for a personal injury lawsuit that the plaintiff voluntarily dismissed.

Steve Leibel of Leibel Law told the Daily Report that retired Georgia Trial Judge Jim Cornwell remained “obstinate” when he and attorney Paul Menair argued that costs handed down by the Lumpkin County Superior Court were illegitimate, forcing them to challenge to the state Court of Appeals.
